Affiliate Program Terms

1. Introduction
These Affiliate Program Terms ("Terms") govern your participation in the EasyViral.ai affiliate program (the "Program") operated by EasyViral.ai ("Provider," "we," "our," or "us").

By enrolling in or participating in the Program, you confirm that you have read, understood, and agree to be bound by these Terms.
Participation is limited to individuals and entities legally capable of entering into binding agreements. If you represent an organization, you warrant that you have authority to bind that organization.
These Terms apply only to the Program and are separate from, and in addition to, our Terms of Service, Privacy Policy, and Cookies Policy. If you also use the EasyViral.ai service as a customer, the Terms of Service continue to govern that use.
The current commission rate, cookie duration, and any special conditions are stated on our Affiliate Program page and may be updated from time to time as described in Section 12.
2. Program Platform (PromoteKit)
The Program is administered through PromoteKit (promotekit.com), a third-party affiliate tracking platform. Your affiliate account, referral links, tracking, reporting dashboard, and payout processing are provided through PromoteKit.
Your use of the PromoteKit platform is additionally subject to PromoteKit's own terms of service and privacy policy. In the event of a conflict between these Terms and PromoteKit's terms regarding your relationship with EasyViral.ai, these Terms control.
We may change the tracking platform used for the Program at any time. If we do, we will provide reasonable notice and instructions for migrating your affiliate account.
3. Enrollment
Enrollment is free and open. You can join instantly by creating an affiliate account through our PromoteKit portal; no prior approval is required to receive a referral link.
However, all affiliate accounts remain subject to ongoing review. We reserve the right to suspend or remove any affiliate whose account information is inaccurate or fraudulent, or whose promotional activity violates these Terms.
You must keep your account details, payment information, and contact information accurate and up to date. We are not responsible for failed or misdirected payouts caused by inaccurate account information.
4. Commissions and Attribution
Commission basis. You earn a recurring commission, at the rate stated on the Affiliate Program page at the time of the sale (currently 30%), on qualifying subscription payments made by customers who sign up through your unique referral link. The commission recurs for each payment the referred customer makes for as long as their subscription remains active.
Attribution.Referrals are attributed on a last-click basis using a 60-day tracking cookie set by the PromoteKit platform. A purchase is a qualifying purchase only when it is properly tracked and attributed by the platform. We are not responsible for tracking failures caused by a user's browser settings, cookie or ad blockers, cleared cookies, or errors in how you implemented your link.
Adjustments. Commissions are not earned on refunded, disputed, fraudulent, chargeback, or otherwise reversed transactions, or on payments made with discounts or credits that reduce the payment to zero. Previously credited commissions for such transactions may be deducted from your balance or future payouts.
Cancellations. If a referred customer cancels or their subscription lapses, commissions for that customer stop accruing from the date the subscription ends.
5. Payouts
Schedule. Commissions are paid monthly on a NET-15 basis: payouts for a given calendar month are generated approximately 15 days after that month ends. This delay allows for refund and fraud verification.
Method. Payouts are made via PayPal. You are responsible for maintaining a valid PayPal account capable of receiving payments and for any fees your payment provider charges.
Minimum threshold. A minimum balance of $25 is required before a payout is issued. Balances below the threshold roll over to the following month.
Taxes. You are solely responsible for all taxes, duties, and fees arising from commissions paid under the Program, and you agree to provide any required tax forms or information upon request.
6. Approved Promotion Methods
The following methods are approved, provided your promotion is truthful and complies with these Terms, applicable law, and the rules of each platform you use:
- Content marketing (blog posts, tutorials, case studies, comparisons, reviews)
- SEO and organic search content
- Organic social media posts, threads, and short-form video
- YouTube videos, livestreams, and podcasts
- Email newsletters to opt-in lists (no unsolicited email)
- Webinars, workshops, courses, and public speaking
- Community forums, Discord, and group posts where permitted by that community's rules
- Personal websites and landing pages with clear, accurate descriptions
- Direct recommendations to clients, students, or your professional network
Paid advertising. Paid advertising (for example, Google Ads, Meta Ads, or TikTok Ads) is permitted, subject to the restrictions in Section 7, including the prohibition on bidding on EasyViral brand terms and on ads that impersonate EasyViral.ai or make misleading claims. You are responsible for your ad spend; commissions are not a reimbursement of advertising costs.
7. Prohibited Conduct
The following are strictly prohibited. Violations may result in reversal of commissions, withholding of unpaid balances attributable to the violation, suspension, or termination:
- Bidding on "EasyViral," "easyviral.ai," or confusingly similar terms or misspellings in search engines, app stores, or ad platforms, or using them in ad display URLs
- Running ads or creating pages, domains, or social accounts that impersonate EasyViral.ai or could mislead users into believing they are dealing with the official EasyViral.ai brand
- Self-referrals: using your own affiliate link to purchase EasyViral.ai for yourself, your business, or any entity you control or have a financial interest in
- Misleading, false, or deceptive claims about EasyViral.ai, its pricing, features, results, earnings potential, or your affiliation with us
- Offering unauthorized third-party incentives (rebates, coupons, discounts, cashback, gift cards) to induce sign-ups, unless expressly permitted by us in writing
- Cookie stuffing, hidden iframes, forced clicks, auto-redirects, or any deceptive or manipulative technique to generate attribution or commissions
- Domain squatting or typosquatting on our brand, or registering social handles or app names containing our trademarks
- Unsolicited commercial email (spam); all email marketing must be permission-based and comply with anti-spam laws
- Using spyware, malware, or any code that violates user privacy or security
- Framing or masking links to mislead users about the destination or your affiliation
- Posting affiliate links in communities or platforms that prohibit them
- Any activity that violates applicable law or the terms of a third-party platform you promote on
8. Disclosure and Compliance
You must clearly and conspicuously disclose your affiliate relationship in accordance with the FTC Endorsement Guides and any local equivalents, for example by stating that your content contains affiliate links and that you may earn a commission.
You are responsible for the accuracy, legality, and quality of your own content and promotions, and for complying with all laws and regulations that apply to your promotional activity in the jurisdictions where you operate.
9. Intellectual Property and Branding
All rights in EasyViral.ai trademarks, logos, and content remain with us or our licensors. We grant you a limited, revocable, non-exclusive, non-transferable right to use our name, logo, and approved marketing assets solely to promote EasyViral.ai under these Terms. This right ends when your participation in the Program ends.
You may not modify our marks, combine them with your own branding in a way that implies partnership or endorsement, or use them in any manner that could cause confusion about the source of the Service.
10. Independent Contractor
You participate in the Program as an independent contractor. Nothing in these Terms creates a partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and us. You have no authority to make or accept offers or representations on our behalf.
11. Review, Fraud, and Reversals
All commissions are subject to review and verification. We may withhold, reverse, or decline commissions that we reasonably suspect were generated in violation of these Terms or through fraudulent activity, and we reserve the right to determine the qualification of transactions and to correct tracking or calculation errors.
12. Term, Termination, and Changes
These Terms apply from the date you enroll and continue until terminated. You may leave the Program at any time by ceasing promotion and notifying us.
We may suspend or terminate your participation at any time for violation of these Terms, suspected fraud, or harm to our brand. Upon termination, you must stop using your referral links and our marketing assets.
Termination does not affect accrued, verified commissions for qualifying transactions that occurred before termination, except where the termination results from fraud or a violation of these Terms, in which case unverified or violation-related commissions may be forfeited.
We may modify the Program (including the commission rate and cookie duration, applied prospectively) or these Terms at any time. For material changes, we will provide notice via the Affiliate Program page, the affiliate dashboard, or email. Continued participation after changes take effect constitutes acceptance. We also reserve the right to discontinue the Program in its entirety, in which case commissions stop accruing from the discontinuation date, and accrued verified balances are paid out per Section 5.
13. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or exemplary damages, or lost profits, arising from the Program. Our aggregate liability for any claims under these Terms shall not exceed the total commissions paid to you in the twelve (12) months preceding the claim or $100, whichever is greater.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Disputes shall be resolved in the same manner as set out in the Dispute Resolution section of our Terms of Service.
