1. Introduction

These Terms of Service ("Terms") govern your access to and use of EasyViral.ai (the "Service"), operated by EasyViral.ai ("Provider," "we," "our," or "us").

By creating an account, purchasing a subscription, or using the Service in any way, you agree to be bound by these Terms, our Privacy Policy, our Refund & Cancellation Policy, and our Cookies Policy(collectively, the "Agreement"). If you do not agree to these Terms, you must not use EasyViral.ai.

2. Service Description

EasyViral.ai is an AI-powered platform that enables users to generate faceless short-form videos for platforms such as TikTok, Instagram Reels, YouTube Shorts, and Facebook Reels.

The Service may include:

AI-generated scripts and voiceovers
AI-generated visuals and art styles
Automated captions and subtitle generation
Background music integration
Voice cloning using user-provided voice samples
One-click video generation
Content scheduling and direct publishing to connected social media accounts

We may modify, update, suspend, or discontinue features of the Service at any time. For material changes that significantly affect paid features, we will provide reasonable advance notice where practicable.

3. Third-Party Service Dependencies

The Service relies on third-party APIs and infrastructure providers for AI processing, including but not limited to image generation, video rendering, voice synthesis, audio generation, AI model routing, and content trend analysis. These providers include, but are not limited to, OpenAI, OpenRouter, Replicate, fal.ai, ElevenLabs, Sarvam AI, and Virlo.

We do not guarantee uninterrupted availability of third-party services. If a third-party provider experiences an outage, modifies their API, or discontinues their service, certain features of EasyViral.ai may be temporarily or permanently affected.

We reserve the right to change, add, or remove third-party providers at any time without prior notice, provided the core functionality of the Service is maintained.

We are not liable for any loss, interruption, or degradation of service caused by third-party providers.

4. Account Registration

To use the Service, you must:

Be at least 16 years of age
Provide accurate and complete registration information
Maintain the confidentiality of your account credentials
Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

4.1 Account Termination by You

You may cancel your account at any time through your account settings or by contacting [email protected]. Upon cancellation:

Your subscription remains active until the end of the current paid billing period.
Upon account deletion, your data enters a 30-day retention period during which it may be recoverable. After 30 days, all personal data, generated content, and voice clone data is permanently deleted (except for legally required financial records). See our Privacy Policy for full details.
We recommend downloading any content you wish to keep before deleting your account.

4.2 Account Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that may harm the Service or other users. Upon termination:

Access to the platform and all associated features will be revoked.
Remaining unused credits will not be forfeited but will be inaccessible for the duration of the termination.
Refunds are generally not issued for accounts terminated due to policy violations.

5. Subscription Plans, Credits & Payments

EasyViral operates on a recurring subscription basis. Plans include monthly or annual credit allocations used to generate videos. Plan details, pricing, and credit costs are listed on our pricing page and may be updated from time to time.

5.1 Credit Usage

Credits are consumed when you generate videos or use features that incur credit costs. Credit costs vary based on:

Video duration (e.g., 30s, 60s, 2 minutes)
Processing options selected
Feature complexity

5.2 Credit Reset & Expiry

Monthly plan credits reset at the start of each new billing cycle. Any unused plan credits from the previous cycle do not carry over and will expire. However, any additional credits purchased separately are non-expiring and will carry forward as long as your subscription remains active. If your subscription is canceled or expires, remaining purchased credits will be available until the end of your current paid period and will not carry over after expiration.

5.3 Credit Terms

Credits are digital usage entitlements with no cash value.
Credits are non-transferable between accounts.
Credits are not redeemable for cash.
Promotional, bonus, or referral credits may have separate expiration terms.

5.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing cycle (monthly or annually) at the then-current rate. By subscribing, you authorize recurring charges to your payment method until you cancel. Cancellation stops future billing but does not refund the current billing period.

5.5 Price Changes

We reserve the right to change subscription pricing. Price changes will not affect your current active billing cycle. We will provide at least 30 days' advance notice before new pricing takes effect on your next renewal. You may cancel before the next renewal if you do not agree with the new pricing.

5.6 Payment Processing

All payments are processed securely through Stripe. We do not store your full payment card details. All prices are listed and charged in US Dollars (USD). Exchange rate differences and international transaction fees are your responsibility.

5.7 Chargebacks and Payment Disputes

You agree to contact [email protected] before initiating a chargeback or dispute with your bank or card issuer.

If a chargeback is initiated without prior contact, we may:

Suspend or terminate your account pending investigation
Submit evidence to contest the dispute, including account data, IP logs, usage history, generation timestamps, and subscription records
Permanently restrict accounts associated with confirmed fraudulent disputes

5.8 Billing Descriptor

Charges will appear on your statement with a descriptor referencing "EasyViral" or a related identifier. If you do not recognize a charge, please contact [email protected] before disputing it with your bank.

6. Refund Policy

Due to the digital nature of the Service and the real costs incurred through third-party AI processing for each video generation, refunds are generally not available once credits have been consumed or videos have been generated.

Refund requests may be considered if submitted within the applicable refund window and no credits have been used during the billing period.

7. Fraud & Suspicious Activity

We reserve the right to suspend or terminate accounts associated with:

High-risk payment flags or failed authentication attempts
Chargebacks or payment disputes filed in bad faith
Suspicious usage patterns or behavior
Attempts to bypass security measures, rate limits, or plan restrictions
Multiple accounts created to exploit promotional offers or credits
Use of stolen payment credentials

We may investigate suspected fraud using account data, IP addresses, device fingerprints, and usage logs. Actions taken in response to fraud are at our sole discretion.

8. Intellectual Property

8.1 Our Platform

The Service, including its design, features, code, AI models, branding, logos, and proprietary systems, is owned by EasyViral.ai and protected by intellectual property laws. You may not copy, modify, reverse-engineer, decompile, or distribute any part of the platform without our written consent.

8.2 Your Content

You retain ownership of the videos and content generated through our platform using your inputs. You are free to use, publish, distribute, and monetize your generated content.

8.3 License You Grant Us

By using the Service, you grant us a limited, non-exclusive, royalty-free, worldwide license to process, store, and transmit your inputs (including text prompts, configurations, and voice samples) solely for the purpose of providing the Service to you. This license terminates when you delete your content or close your account.

8.4 Background Music

Background music and audio assets provided through the Service are licensed for use within videos generated on our platform. The scope of this license is limited to content created through EasyViral.ai. We do not guarantee that all audio assets are cleared for every use case or jurisdiction. You are responsible for ensuring compliance with the terms of any platform where you publish your content.

9. Voice Cloning Terms

EasyViral.ai offers a voice cloning feature that allows you to create a custom AI voice using your uploaded or recorded voice samples. By using this feature, you agree to the following:

Ownership and Rights: You represent and warrant that you have the legal right to use any voice you submit for cloning. If the voice belongs to another individual, you must have their explicit written consent before uploading.
Prohibited Uses: You may not use voice cloning to impersonate any individual without their consent, create deceptive or misleading content, commit fraud, harass or threaten others, or produce content that violates applicable laws.
Third-Party Processing: Voice data is processed by our third-party voice synthesis provider, ElevenLabs, subject to their applicable terms and privacy policy.
Biometric Data: Voice samples may be classified as biometric data in certain jurisdictions. See our Privacy Policy Section 2.4 for full details on voice data handling.
Deletion: You may delete your voice clone at any time from your account settings. Associated voice data will be permanently removed from our systems within 30 days of deletion.

We reserve the right to remove any voice clone or restrict voice cloning access if we reasonably believe it is being used in violation of these Terms.

10. AI-Generated Content Disclaimer

Content generated by our platform is created using artificial intelligence. While we strive for quality and accuracy:

AI-generated content may contain inaccuracies, errors, or unintended outputs.
You are responsible for reviewing and approving all generated content before publishing or distributing it.
We do not guarantee that generated content will be suitable for any particular purpose.
You are solely responsible for ensuring your use of generated content complies with applicable laws and the terms of any platform where you publish it.

10.1 No Guarantee of Results

We do not guarantee social media growth, engagement, followers, views, monetization, revenue, or viral performance. Results depend on external factors beyond our control, including but not limited to platform algorithms, content quality, audience preferences, posting timing, and market conditions.

Any examples, case studies, or performance metrics shared on our website or marketing materials are illustrative only and do not constitute a guarantee of similar results.

11. Social Media Publishing

EasyViral.ai allows you to connect third-party social media accounts for direct video publishing. By using this feature:

You represent that you have authorization to publish content to the connected accounts.
You are responsible for complying with the terms of service, community guidelines, and content policies of each social media platform (including TikTok, Instagram, YouTube, and Facebook).
We are not liable if your content is removed, restricted, or if your social media account is penalized, suspended, or terminated by any platform as a result of content you publish.
We are not responsible for changes to third-party platform APIs that may affect publishing functionality.

12. Prohibited Uses

You may not use the Service to:

Generate content that is illegal, harmful, threatening, abusive, or defamatory
Create deepfakes or deceptive impersonations of real individuals without their consent
Produce misinformation, disinformation, or deliberately misleading content
Generate content depicting violence, hate speech, explicit sexual material, or child exploitation material (CSAM)
Infringe on the intellectual property rights of others
Spam, harass, stalk, or threaten others
Impersonate any person or entity, or misrepresent your affiliation
Circumvent content moderation, safety filters, or usage restrictions
Attempt to reverse-engineer, decompile, or extract source code from the platform
Interfere with or disrupt the Service or its infrastructure
Use automated systems (bots, scrapers) to access the Service beyond normal usage patterns
Resell, sublicense, or redistribute the Service or generated content as a competing service
Bypass plan limits, exploit free trials, or abuse promotional offers using multiple accounts
Use the Service in violation of any applicable local, national, or international law

We reserve the right to suspend or terminate accounts that violate these guidelines without prior notice. Content generated in violation of these Terms may be removed at our discretion.

13. DMCA & Copyright Claims

We respect intellectual property rights. If you believe that content on our platform infringes your copyright, you may submit a takedown notice to our designated DMCA agent.

Your notice must include:

Identification of the copyrighted work you claim has been infringed
Identification of the infringing material and its location on the Service
Your contact information (name, address, email, phone number)
A statement that you have a good faith belief that the use is not authorized
A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
Your physical or electronic signature

We may remove or disable access to allegedly infringing content and may terminate accounts of repeat infringers.

14. Data Storage

User-generated videos and assets may be stored for up to 90 days from the date of generation, unless deleted earlier by the user. After this period, content may be permanently deleted.

We recommend downloading any content you wish to keep promptly after generation.

15. Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

The Service will be uninterrupted, secure, or error-free
The results obtained from the Service will be accurate or reliable
The quality of any content generated will meet your expectations
Any errors in the Service will be corrected

You acknowledge that your use of the Service is at your sole risk. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYVIRAL.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, GOODWILL, SOCIAL MEDIA ENGAGEMENT, OR REVENUE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred US dollars ($100 USD), whichever is greater.

These limitations apply regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so the above limitations may not apply to you to the extent prohibited by law.

17. Indemnification

You agree to indemnify, defend, and hold harmless EasyViral.ai, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Content you generate, publish, or distribute using the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Your misuse of voice cloning features
Content published to third-party platforms through your connected accounts

18. Dispute Resolution & Arbitration

18.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at [email protected] and attempt to resolve the matter informally for at least 30 days.

18.2 Binding Arbitration

If we cannot resolve the dispute informally, any controversy or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

The arbitration shall be conducted in the State of Delaware, United States, or at another mutually agreed location. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

18.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the dispute shall proceed in court.

18.4 Exceptions

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the infringement or misappropriation of intellectual property rights.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, pandemics, war or terrorism, power outages, internet or telecommunications failures, third-party API outages or changes, cyberattacks, or labor disputes.

20. Electronic Communications

By creating an account or using the Service, you consent to receive communications from us electronically, including via email and in-app notifications. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

21. Export Compliance

The Service is operated from the United States. You agree to comply with all applicable US and international export laws and regulations. You may not access or use the Service if you are located in a country subject to US sanctions, or if you are listed on any US government restricted party list.

22. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

For any disputes not subject to arbitration, the courts located in the State of Delaware shall have exclusive jurisdiction.

23. Modifications to These Terms

We may modify these Terms at any time. When changes are made:

The effective date at the top of this document will be updated.
For material changes, we will provide at least 30 days' advance notice via email or in-app notification before the changes take effect.
Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
If you do not agree with the updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.

24. General Provisions

24.1 Entire Agreement

These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and Cookies Policy, constitute the entire agreement between you and EasyViral.ai regarding the Service and supersede all prior agreements and understandings.

24.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

24.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of EasyViral.ai.

24.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

24.5 Survival

Provisions that by their nature should survive termination shall remain in effect, including but not limited to: intellectual property rights, warranty disclaimers, limitation of liability, indemnification, dispute resolution, and any accrued payment obligations.
